Do I Need Products Liability Cover?

Products Liability Insurance is not a compulsory class of insurance.

However as litigation becomes more prevalent, it has become the norm for businesses to take out this type of cover. If you have a claim made against you or your business then product liability insurance should make the outcome less likely to be as damaging.

Having products liability insurance will provide you with peace of mind, knowing that any potential claims will be defended on your behalf by your insurer. You will be saved the considerable time and energy and cost in defending your case.

I'm a small electrical retailer - why do I need product liability insurance?

Even if you only sell goods and don't manufacture them, you still have a legal responsibility not to sell dangerous goods.

Be aware too that often the manufacturer is no longer in business and the importer can't be traced, in which case the shop owner could face a liability claim.

Under law, wholesalers and retailers alike are liable if they can't identify the producer, importer or "own-brander" (a supplier who puts their own label on the product to give the impression they are the makers).

  • If you lose you pay compensation/damages, medical costs and legal fees
  • Should you win you need to recover as much of your legal costs from the claimant - rarely are legal fees recoverable in full

With Product Liability Cover

  • The injured party (claimant) begins a claim for compensation
  • You pass the claim documents to your insurance broker
  • You can carry on with your business
  • You provide the insurers and their solicitors with information
  • The legal complexities and costs are handled by the insurance company
  • If you lose the case in or out of court (you will have legal advice) then the insurer pays the compensation/damages/legal costs
  • If the claim is found for you (ie you win the case), then the insurer collects the legal costs from the claimant

As product liability insurance in not compulsory the decision to insure belongs with each business owner or director. Insurance is the pooling or risk and as such the cost of premiums reflects the level of risk associated with your type of product manufacturing, distribution and/or sales operation.
